Board Dismisses RHPNS Recusal Motion in Halifax Water Rate Case
Board Chair Refuses to Recuse Himself from Panel Despite Challenge of Bias
On July 14, 2025, the Nova Scotia Utility and Review Board dismissed a motion from Rental Housing Providers Nova Scotia (RHPNS) requesting the recusal of Board panel member Bruce Fisher from the Halifax Water 2025 General Rate Application proceeding (M12257). The motion raised concerns about a reasonable apprehension of bias due to Mr. Fisher’s past senior role with Halifax Regional Municipality (HRM) and possible perceived institutional loyalty.
Notably, the decision on the recusal request was made by Mr. Fisher himself, the panel member whose impartiality was being challenged. After reviewing the submissions, Mr. Fisher concluded that there was no direct or indirect financial relationship between himself and either HRM or Halifax Water. He also determined that a reasonably informed person would not perceive him as biased or unable to hear the case fairly.
Submissions on the motion were received from RHPNS, the Consumer Advocate (who opposed the motion), and the Province of Nova Scotia (which took no position).
Mr. Fisher confirmed that he has not formed any opinion on the General Rate Application and will continue to serve on the panel reviewing Halifax Water’s proposed rate increases.
